Terms of Service

1. Acceptance of terms

By accessing or using Construpilot (the “Service”), operated by Construpilot, Inc. (“Construpilot,” “we,” “us”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, you may not use the Service.

2. Description of service

Construpilot provides a software-as-a-service platform for commercial construction workflows, including project management, bid marketplace, document management, and project finance features for general contractors and subcontractors.

3. Accounts

You must register an account and an organization to use most features. You are responsible for maintaining the confidentiality of your magic-link sign-in email and for all activity that occurs under your account.

4. Acceptable use

You agree not to:

  • upload or transmit malicious code or content you do not have rights to;
  • impersonate another person or organization;
  • circumvent or attempt to circumvent the Service's access controls;
  • use the Service for any illegal purpose or in violation of applicable laws.

5. Subscriptions and fees

Paid plans are billed in advance on a monthly per-seat basis as described on the pricing page. ACH payments routed through the platform incur a flat 1.5% platform fee. All fees are non-refundable except where required by law.

6. Termination

You may cancel your subscription at any time. We may suspend or terminate access if you materially breach these Terms. Upon termination, your access ceases; we retain data per the retention schedule in our Privacy Policy.

7. Disclaimers

The Service is provided “as is” without warranty of any kind. We do not warrant the Service will be uninterrupted, error-free, or that it will meet your specific requirements.

8. Limitation of liability

To the maximum extent permitted by law, Construpilot's aggregate liability for any claims arising out of or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Venue for any dispute lies in the state and federal courts located in Miami-Dade County, Florida.

10. Changes

We may update these Terms from time to time. We will notify users of material changes via email and an in-app notice at least 30 days before the changes take effect.
